These Terms of Use govern your access to and use of qulturecare.com, PractitionerLab, and other services provided by QultureCare.

By accessing or using our website or services, you agree to these Terms.

1. Who we are

QultureCare provides evidence-based learning, development and wellbeing solutions for individuals, practitioners and organisations.

Our services may include:

• Practitioner training and learning tools
• AI-powered simulated practice through PractitionerLab
• Coaching and professional development
• Workplace wellbeing and organisational services
• Educational resources and other related services

Some services may be governed by additional agreements or engagement terms.

2. What PractitionerLab is — and isn't

PractitionerLab is an AI-powered learning and practice environment designed to help users practise counselling and related professional skills using simulated clients.

PractitionerLab:

• Uses fictional, AI-generated personas and scenarios
• Is intended to support learning, reflection and skills development
• Does not replace professional education, clinical supervision, mentoring or professional judgment
• Does not provide professional certification, qualification or licensing
• Does not guarantee professional competence or readiness to practise independently

AI-generated feedback is intended as a learning and reflective aid. It should not be treated as a definitive clinical assessment, professional evaluation or diagnosis.

Users remain responsible for working within their professional scope of competence and complying with applicable ethical, educational and professional requirements.

3. Your account

You may be required to create an account to access certain PractitionerLab features.

You are responsible for:

• Providing accurate information
• Keeping your login credentials secure
• Activity that occurs through your account
• Not sharing your account with others without permission

Please notify us if you believe your account has been accessed without authorisation.

4. Acceptable use

When using QultureCare or PractitionerLab, you agree not to:

• Use the platform for unlawful purposes
• Submit false or misleading information
• Attempt to interfere with, disrupt or gain unauthorised access to our systems
• Reverse engineer, scrape, copy or reproduce the platform or its content without permission
• Upload malicious code or attempt to compromise platform security
• Misrepresent PractitionerLab sessions, feedback or usage as formal clinical hours, certification or qualification unless explicitly recognised by an authorised institution
• Enter confidential or identifiable information about real clients or other individuals without appropriate authority

We may suspend or restrict access where reasonably necessary to protect our services, users or systems.

5. Your content and practice sessions

You remain responsible for the information and content you submit while using PractitionerLab.

By using the platform, you permit QultureCare and its service providers to process your submitted information as necessary to:

• Operate PractitionerLab
• Generate simulated interactions and feedback
• Store your session history
• Maintain and improve the platform

This processing is subject to our Privacy Policy.

6. Intellectual property

QultureCare and PractitionerLab, including their branding, software, designs, personas, content, methodologies and other materials, are owned by or licensed to QultureCare.

You may use the platform for its intended purpose.

You may not copy, reproduce, distribute, commercially exploit or create derivative works from our content or platform without our written permission, except where permitted by applicable law.

7. Coaching and organisational engagements

Specific coaching, consulting or organisational engagements may be governed by separate agreements covering matters such as:

• Scope of work
• Deliverables
• Fees
• Confidentiality
• Cancellation
• Intellectual property

Where a separate written agreement applies, that agreement will govern the relevant engagement.

8. Service availability and changes

We may update, modify, suspend or discontinue features of QultureCare or PractitionerLab from time to time.

We do not guarantee that the platform will always be available, uninterrupted or error-free.

9. No medical or professional advice

Unless expressly agreed as part of a separate professional engagement, QultureCare and PractitionerLab do not provide medical, psychiatric, emergency, legal or diagnostic advice.

If you are experiencing an emergency or immediate risk of harm, seek appropriate emergency or professional support.

10. Limitation of liability

To the maximum extent permitted by applicable law, QultureCare provides its website and PractitionerLab on an "as is" and "as available" basis.

We are not responsible for indirect, incidental or consequential losses arising from your use of our services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

11. Changes to these Terms

We may update these Terms as our services evolve.
